Rules for Use of the Neuerburg Via Ferrata
Scope of Application
These Terms of Use govern the use of the Neuerburg via ferrata and apply to all
persons entering the via ferrata.
Eligibility
1.1
Children under the age of 18 may use the Neuerburg via ferrata only under
the supervision of a parent or legal guardian or another adult who is authorized to exercise such
supervision.
Children in particular face special risks while on the via
ferrata and especially while climbing, for which parents or other guardians must take precautions
on their own responsibility. Playing in areas of the climbing route where
objects or climbers may fall is prohibited. A minimum height of 1.40 m applies for entering the
via ferrata.
1.2
The Neuerburg via ferrata is intended primarily for private use.
Any commercial use, particularly in the context of guided
tours, courses, or other paid events, requires prior
registration and approval from Felsenland Südeifel Tourismus GmbH
(info@felsenland-suedeifel.de, Tel. 06526/933930). For approved commercial uses, a usage fee of EUR 5.00
per participating person will be charged. The
usage fee must be paid by the organizer. The person in charge of
the event must ensure that all participants are familiar with the rules of use and fully
comply with them during their visit. The organizer is liable, within the scope of
legal regulations, for violations of these rules of use by their participants.
Details regarding approval as well as the collection and processing of the usage fee
may be specified in separate regulations.
1.3
In the event of intentional or grossly negligent violations that result in additional administrative
or safety costs, a fee of up to 100 EUR may be
charged. In addition, the facility operator
or the commissioned third party reserves the right to issue an immediate warning and a ban from the premises.
1.4
The Neuerburg via ferrata is open year-round. The via ferrata must not be used in bad weather (e.g., risk
of thunderstorms, lightning, snow, and ice, as well as during storms and rain)
or after dark. Each user is
responsible for taking appropriate precautions upon entering the via ferrata and for
checking the weather forecast.
Climbing Rules and Liability
2.1
Staying on and using the Neuerburg via ferrata, particularly climbing,
is done exclusively at one’s own risk and responsibility. If
liability should nevertheless arise, the City of Neuerburg shall not
be liable for damages other than those resulting from
injury to life, limb, or health, unless the damage was caused by its intentional or grossly negligent
conduct. The City of Neuerburg’s liability for simple
negligence is excluded, provided that no material safety obligations
have been violated.
2.2
Every user must show the utmost consideration for other users and refrain from any
action that could endanger themselves or third parties. Every user
must anticipate that they could be endangered by other
users or falling objects and must take appropriate precautions on their own responsibility.
2.3
Access to the Neuerburg via ferrata is permitted only with personal protective equipment
designed for this purpose. This includes a via ferrata fall arrest device compliant with EN 958 and appropriate for
the user’s body weight, a climbing harness compliant with EN 12277, a mountaineering helmet compliant with EN 12492,
climbing gloves, and sturdy footwear.
2.4
Open fires or the use of grills are not permitted on the Neuerburg via ferrata.
Use of the via ferrata after consuming alcohol or other intoxicating
substances is prohibited.
2.5 Areas marked
as closed must not be entered or traversed. The
operator of the Neuerburg via ferrata reserves the right to close the entire via ferrata
or sections thereof.
2.6 Depending on weather
conditions, the access routes to the via ferrata may present particular hazards due to moisture, ice, or snow, among
other factors.
2.7
The Neuerburg via ferrata and the entire premises must be kept clean and treated
with care.
2.8 Any trash
generated must be disposed of properly and at your own responsibility.
2.9
The right of access to the Neuerburg via ferrata is exercised by the Südeifel Municipal Association, the
City of Neuerburg, and Felsenland Südeifel Tourismus GmbH, as well as their representatives.
Their instructions must be followed. Anyone who violates the rules of use may be
permanently or temporarily barred from using the via ferrata. The
right to
assert claims for damages arising from violations of the rules of use remains unaffected by this.
3.0
The rules of use are posted at the entrance to the via ferrata and are available online. By entering
the via ferrata, you acknowledge and agree to the rules of use.
